TheatreBC Club Card

Terms & Conditions


The Theatre BC Club Card Program (the “Program”) is a membership loyalty program offered by The British Columbia Drama Association (“Theatre BC”)

To participate in the Program, a customer must become a member (a “Member”) of the organization online at www.theatrebc.org.

Membership enrollment is available on a 1 year or 3 year basis to the residents of Canada, and who pay the appropriate membership fee (CDN $) plus any applicable sales or value-added tax (the “Membership Fee”). Membership fees, and additional membership details, are outlined on the Theatre BC website.

A Member may cancel his/her membership at any time by notice in writing to Theatre BC. Membership Fees are non-refundable except where required by applicable law.

By enrolling, you acknowledge and agree that the information you provide in the enrollment process is true and correct in all material respects.

Upon membership acceptance, Theatre BC will issue you a unique membership card the “Theatre BC Club Card” (the “Card”), with the Member’s name and ID number on the Card.

Membership entitles you all of the services and discounts outlined on our website (www.theatrebc.org ) under “Membership” and “Theatre BC Club Card.”

Your membership is non-transferable and discounts are only available to the Member whose name appears on the Card, subject to these terms and conditions.

It is the Member’s responsibility to immediately advise Theatre BC of any address, email, phone number or name changes on a timely basis. Theatre BC is not responsible for any misdirected or lost mail. Please mail your address change notification to Theatre BC, Old Courthouse Cultural Centre, 7 Seymour Street West, Kamloops, BC V2C 1E4 (778) 471-5620 or e-mail us at admin@theatrebc.org.

The Card is the property of Theatre BC and may be unilaterally revoked or cancelled at any time by Theatre BC in its sole discretion, with or without notification to you.

Abuse of Program privileges or failure to follow the terms and conditions of this Program may subject your membership to cancellation, without refund of the Membership Fee.

Unauthorized reproduction of the Card shall result in cancellation of the Card and may result in legal prosecution.

This Program will remain in effect for 1 or 3 years (as set out by the member when membership is purchased), unless cancelled by Theatre BC, in our sole discretion.

By enrolling, you acknowledge and agree that you have provided Theatre BC with your personal information. At Theatre BC, the security and integrity of our customers’ personal information is important to us. We take every reasonable measure necessary to protect the privacy of our members.

Theatre BC’s privacy practices are in compliance with all federal and provincial laws and regulations.

Theatre BC collects and uses your personal information for updates and for contact purposes. Theatre BC does not use or disclose personal information for purposes other than those for which it was collected, except with the consent of the Member or as required by law. Theatre BC retains personal information only as long as necessary for the fulfillment of those purposes. Theatre BC does not give, rent or sell your membership information to any organization or third parties.

Theatre BC informs Members of the existence, use and disclosure of their personal information upon request and gives them access to their information. You can request or change your personal information by notifying Theatre BC.

Theatre BC will be the final authority as to the interpretation of these terms and conditions and whether any item qualifies under the terms of this Program.

This Program and the terms and conditions of the Program are subject to change by Theatre BC, in our sole discretion, without notice. Notice of changes may, at Theatre BC’s sole discretion, be communicated to Members via direct mailings, sent by email or posted online at www.theatrebc.org. This Program is subject to applicable federal, provincial and municipal laws.

THE CARD, PROGRAM, MEMBERSHIP AND THE INFORMATION, PRODUCTS AND SERVICES MADE AVAILABLE OR OFFERED BY THEATRE BC IN CONNECTION WITH ANY OF THE FOREGOING ARE PROVIDED ON AN “AS IS” BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. THEATRE BC HEREBY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT AS TO THE CARD, PROGRAM, MEMBERSHIP AND THE INFORMATION, PRODUCTS AND SERVICES OFFERED IN CONNECTION WITH ANY OF THE FOREGOING.

IN NO EVENT WILL THEATRE BC, ITS AFFILIATES OR ANY OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES OR AGENTS BE LIABLE FOR ANY DIRECT, SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES, OR ANY OTHER DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF PROFITS OR LOSS OF DATA, WHETHER IN AN ACTION IN CONTRACT, TORT (INCLUDING BUT NOT LIMITED TO NEGLIGENCE) OR OTHERWISE, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OF OR INABILITY TO USE THE CARD, MEMBERSHIP, PROGRAM, OR ANY PRODUCTS, SERVICES, OR INFORMATION PROVIDED IN CONNECTION WITH ANY OF THE FOREGOING. IN NO EVENT WILL THE AGGREGATE LIABILITY OF THEATRE BC, WHETHER IN CONTRACT, WARRANTY, TORT (INCLUDING NEGLIGENCE, WHETHER ACTIVE, PASSIVE OR IMPUTED), PRODUCT LIABILITY, STRICT LIABILITY OR OTHER ANY OTHER THEORY, ARISING OUT OF OR RELATING TO THE USE OF OR INABILITY TO USE THE CARD, MEMBERSHIP, PROGRAM OR THE INFORMATION, PRODUCTS AND SERVICES PROVIDED IN CONNECTION WITH ANY OF THE FOREGOING EXCEED THE MEMBERSHIP FEE PAID BY MEMBER.

This Program is subject to applicable federal, provincial and municipal laws. These terms and conditions and your use of the Program shall be governed by and construed in accordance with the laws of British Columbia and laws of Canada applicable therein, without regard to its conflict of law provisions. You agree that any suit arising out of or relating to these terms and conditions shall be filed only in the courts located in the Province of British Columbia and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit or proceeding arising out of these terms and conditions or your use of the Program.

All images, text, designs, data and other content on the Card and other materials used in connection with the Program, including, without limitation, the names “Theatre BC” and “Theatre BC Club Card” are the property of Theatre BC and involve valuable, copyright, trademark, trade secret and other proprietary rights of Theatre BC. Theatre BC reserves all such rights. Except for the Member’s limited right to use the Card for the Program in accordance with these Terms and Conditions, nothing in these Terms and Conditions or elsewhere will be construed as conferring any license to any such materials, or any intellectual property rights therein, whether by estoppel, implication or otherwise.

By enrolling in the Program and by using the Card, you: (i) certify that you are over the age of majority in the province in which you reside; (ii) consent to Theatre BC’s use of your personal information and Theatre BC’s privacy practices as set out in these terms and conditions; and (iii) agree to these terms and conditions of the Program, as may be amended from time to time.

Effective November 17, 2011, these terms and conditions supercede and replace all previously published terms and conditions relating to the Program.
